(Charlotte Cuthbertson/The Epoch Times) Title 42 Governors, Border Patrol agents, and border sheriffs have expressed concern over the revocation of Title 42—a public health provision that allowed for the quick expulsion of illegal immigrants.

Under Title 42, border agents can quickly expel illegal aliens because they may have COVID-19, the disease caused by the CCP (Chinese Communist Party) virus.

The Biden administration early on stopped using Title 42 against illegal immigrant children who arrive without a responsible adult.

The Biden administration has attributed a drop in numbers arriving at the southern border to new measures that replaced Title 42 in May.

With Title 42 potentially ending, is the Biden administration ready to handle the expected influx of illegal immigrants? Officials testified on what they’re planning to do, amid pushback from Republicans.

Title 42 is a pandemic-era health order that enables border agents to quickly expel some illegal immigrants over fears they are infected with COVID-19.

Title 42 is a public health law allowing the government to keep people from entering the country during a public health emergency. The Trump administration invoked it in March 2020 during the Covid pandemic.

Title 42 will end on May 23.  Some are warning that this will create a greater crisis at the border.  Among them is the head of the Border Patrol union and Florida's governor.

Leeser warned last week that approximately 20,000 migrants were waiting to cross into the United States from Mexico upon the expiration of the Trump-era Title 42 program.

Without the Title 42 order, the Biden administration has centered much of its strategy for processing on a parole program, and an online and mobile application portal called CBP One.

In a press conference on the banks of the Rio Grande, he appealed to keep Title 42 and criticized Secretary of Homeland Security Alejandro Mayorkas over the uncontrolled influx of illegal migrants.

The increase of recent migrants into the United States came before the lifting of Title 42, which heightened restrictions on asylum seekers from entering the country during the COVID-19 pandemic.

Even with Title 42 in place, the flow of migrants into the country has continued. Much of the national media have ignored, or played down, the invasion (let’s call it what it is), but a visit to Fox News dramatically shows the problem.

Supreme Court Justice John Roberts temporarily blocked on Monday an order that would have lifted Title 42 on Dec. 21.

"Along [with] @America1stLegal & @IRLILaw, I sued the [administration] for failing to use Title 42, [contributing] to [a] massive wave of smuggling. [Federal] court just BLOCKED Biden from excepting alien minors from the Title 42 process.

Because of the forecasts and the recently announced decision to end Title 42, “ICE must shift its focus and prepare to manage its resources for a population of up to 600,000 by the end of the fiscal year,” Dougherty added.

Agents are bracing for an even higher influx as the Biden administration prepares to end Title 42 expulsions on May 23.

Out of these, 56 percent were processed for expulsion under Title 42 and the remaining under Title 8. Among family unit individuals, 14,028 were expelled under Title 42 and 37,752 under Title 8.

When Title 42 expired on May 11, would-be illegal migrants were uncertain how the Biden administrations would respond.

Also in April, Moody filed an amended complaint to a multi-state lawsuit filed by Arizona, Louisiana, and Missouri opposing the administration’s plan to end the public health authority, Title 42.

They also urged leaders in both chambers to pass legislation "to give Border Patrol back the expulsion authority that expired last year," referring to what's known as Title 42, a pandemic-era measure that allowed authorities to expedite the removal of

The Supreme Court, in late December 2022, ordered the administration to keep Title 42 in place.

Among the more than 213,000 illegal aliens deported from the border in July, only 37 percent of the arrests led to expulsions under Title 42—a 7 percent drop from last month.

Yet Border Patrol agents are bracing for an even bigger influx of illegal immigrants after the Biden administration announced in April its plans to drop the Title 42 public health provision on May 23.

Mayorkas said his department is increasing its capacity to deal with the influx of illegal immigrants after the administration ends Title 42, by using standard procedure under Title 8.
