Mark Krikorian, executive director of the Center for Immigration Studies, said the Biden administration is not applying the Title 42 authority, which enables quick expulsion of illegal immigrants, to natives of Venezuela, Nicaragua, and Cuba. 

The drop-off policy stemmed from the Biden administration’s move to lift a Trump-era emergency public health order, known as Title 42, which had allowed for the quick expulsion of asylum-seekers entering the country during the COVID-19 pandemic.

“By placing into expedited removal families who cannot be expelled under Title 42, we are making clear that those who do not qualify to remain in the United States will be promptly removed.”

Border crossing dynamics shifted in May after the Biden administration stopped implementing Title 42, a pandemic-era public health policy that turned many illegal immigrants. 

Biden has exempted unaccompanied children from Title 42 but kept it for single adults and many families.

Mayorkas is accused of endangering national security by encouraging illegal immigration by terminating contracts for additional border wall construction, ending the Migrant Protection Protocols, and attempting to eliminate Title 42 authority.

While the figures for May when Title 42 ended have not been compiled, monthly records for illegal crossings have been set and shattered repeatedly under Biden. In April, U.S.

The administration plans to invoke Title 42, a rule created during the Trump administration and one Biden denounced for inflicting “cruelty and exclusion” on those fleeing the government of Venezuelan dictator Nicolás Maduro.

The decision is not related to the administration’s plan to end the so-called Title 42 policy at 11:59 p.m. on May 11. The Trump-era edict allows the rapid expulsion of illegal aliens crossing the U.S.-Mexico border on public health grounds.

However, negotiations hit an impasse after senators couldn’t agree on an amendment proposed by Lee, which would extend the COVID-19 pandemic-era Title 42 border policy. McCarthy is opposed to the spending package. Sen.

Code Title 42 expires on May 3. Title 42, which evolved from a federal health order enacted in 1944, prohibits people from entering the United States during a pandemic to mitigate the spread of disease. 

Since the sun set on Title 42 earlier this year, border arrests have increased, but so have the got-aways who arrive from all corners of the globe.

Most recently, the Biden administration insisted on ending Title 42, a clause from a 1944 public health law the Trump administration had used to limit illegal immigration during the COVID pandemic.

Border Patrol agents and local officials along the border are bracing for an even greater influx of illegal immigrants as the Biden administration prepares to drop the Title 42 public health provision on May 23.
