President Donald Trump said on Feb. 20 that he will issue an executive order to create a 10 percent “global tariff,” announced shortly after the SupremeCourt invalidated his reciprocal duties on U.S. trading partners.
In its 6–3 decision, the SupremeCourt ruled that nationwide injunctions exceeded the power that Congress had granted federal courts in the Judiciary Act of 1789.
In a 49-page opinion, the SupremeCourt noted procedural flaws in McCormick's analysis, restoring the incentive plan designed to drive Tesla's expansion.
The SupremeCourt reversed the decision of the U.S. Court of Appeals for the Fifth Circuit and sent the case back to that court for further proceedings consistent with the opinion.
Court Ruling Limits Emergency Tariff Powers
The Supreme Court's Feb. 20 decision found that Trump lacked authority under the IEEPA to impose sweeping tariffs on dozens of trading partners.
The SupremeCourt on June 23 temporarily lifted a lower court order blocking the Trump administration from deporting illegal immigrants to so-called third countries to which they have no connection.
In its Dec. 15 ruling, the SupremeCourt vacated the Sixth Circuit ruling and sent the case back to that court “for further consideration in light of Lackey v. Stinnie.”
If the SupremeCourt accepts Ottawa’s argument, it would tip the democratic balance, giving the courts more political power and leaving the provinces with less.
The doctors asked the SupremeCourt to weigh in to clarify the limits of the immunity because different circuit courts have judged those limits differently.
Even if the SupremeCourt doesn’t take up the administration’s request to overrule Humphrey’s Executor, it could still uphold Trump’s firing of Slaughter.
The SupremeCourt is considering a Texas woman’s lawsuit claiming that the United States Postal Service (USPS) engaged in racial discrimination when it stopped delivering her mail.
On Sept. 22, the SupremeCourt decided to hear Trump’s appeal of a U.S. Court of Appeals for the District of Columbia Circuit ruling in favor of Slaughter.
