The other, charging him with illegally retaining classified documents at his Mar-a-Lago estate in Palm Beach, Florida, was dismissed in July by U.S. District Judge Aileen Cannon.
That judge said Smith’s appointment as special counsel was unlawful.
But Trump and some members of his team have repeatedly stated that, as president, he had a standing declassification order on materials that left the Oval Office and were taken to Mar-a-Lago.
The case, which dealt President Trump nearly three dozen counts in June, involves allegations that the former president illegally retained classified documents at his Mar-a-Lago estate after he left office.
The billionaire was invited to Mar-a-Lago for Trump's 2024 election night victory party in Florida. She also met with fellow billionaire Elon Musk in Florida the next morning.

The governor said he has “the receipts” from the first administration and is now preparing for similar confrontations in the coming years.
The two met most recently at Trump's Mar-A-Lago resort in Palm Beach, Florida, on Nov. 22, 2024, to discuss a range of global security issues facing the alliance.
