Bump stocks were banned in 2019 when the Department of Justice (DOJ) amended regulations of the ATF, classifying bump stocks as equivalent to machine guns and making them illegal.

A “bump stock” uses a rifle’s recoil to enable a shooter to greatly increase the rate of firing. So the court had to decide whether a bump stock converts a semiautomatic weapon into a machine gun.

In 2018, the ATF issued a regulation that interpreted the term “machine gun” expansively and banned bump stocks for the first time. The agency outlawed bump stocks, finding they qualify as machine guns under federal law.

Bump stocks can be used to harness the recoil energy of, e.g., semi-automatic rifles, "bumping" the trigger against the users trigger finger to fire the next round—thus increasing the rate of fire.

On Dec. 18, 2018, the ATF issued a new rule declaring bump stocks illegal and ordering the owners to either turn in their bump stocks or destroy them. Samp said the ATF exceeded its authority.

The judges also wrote that a bump stock cannot change a semi-automatic weapon into a fully automatic, select-fire machine gun.

Maryland's ban preceded a nationwide ban on the sale and possession of bump stocks that was put in place by the Trump administration and took effect in 2019.

“Any semi-automatic can be bump-fired, with or without a bump stock,” Jaffe said. Online videos show that even a belt loop can be used as a bump-fire device and, with some skill, a similar effect can be achieved with no device at all.
