
Apple this week lost a bid to have the court ban the U.S. release of the much-anticipated Samsung Galaxy S III, but the Cupertino, Calif.-based electronics giant will continue its existing patent dispute against Samsung.
Last week, Apple asked the U.S. District Court in San Jose, Calif. to impose an injunction on the smartphone before it is released nationwide on June 21. Apple requested to add the Galaxy S III case to its Galaxy Nexus complaint because the Galaxy S III “contains two of the exact infringing features already at issue,” Apple said. Yet Samsung argued that it is too late for Apple to add new products to the complaint.
U.S. District Court Judge Lucy Koh gave Apple an opportunity to request a temporary restraining order (TRO) against the Galaxy S III, but Koh said doing so would delay the current patent trial schedule.
Apple gave up its chance on the TRO and as a result the two sides will meet for a hearing on June 21, while the trial is set for July 30.
“If Apple seeks to file a motion to enjoin sales of the Samsung Galaxy S III, Apple will have to request a new hearing date from the court,” Koh wrote on Monday.
